This is a binding contract regarding the sale of puppies offered by the Patrick and Elizabeth Sullivan (d.b.a. Tiger Lake Bulldogges), hereafter referred to as the Sellers, and by____________________________________, hereafter referred to as the Buyer/Buyers currently residing at __________________________________(address).
This contract is mutually entered into by both said above parties the day of____________________. The following terms shall supersede any real or perceived verbal contracts between above said parties. Any changes to the contract terms must be in writing and attached as an addendum. Any legal action regarding this agreement shall take place within
The Buyer/s have chosen to purchase a puppy named_____________________, and whelped on, __________, with the sex of (M F), and physically described as______________________________________________. For the price of ____________. A deposit of ________________will hold the above said puppy until the pick up date of_____________. If the Buyer/s fail to pick up the puppy by ______________________, the Buyer/s forfeit the deposit and the dog may be sold by the Sellers at their sole discretion. The Buyers will forfeit any right to the ownership of the said puppy. Once the puppy is picked up, Buyers’ assume all expenses for the care of the puppy including veterinarian bills.
The Buyer/s agrees to have the puppy spayed or neutered as soon as their Veterinarian recommends, but no later than eight months of age. If the Buyer fails to do so, any warranty offered by the Seller is void. No breeding rights shall be available for this puppy. If this puppy is ever breed for any reason the Buyer/s will pay a breeding puppy fee of $1000.00 to the Sellers.
The Seller offers a health guarantee based on the following terms. The Buyer shall have their puppy inspected by a Listened Veterinarian within 72 hours of the puppy being picked up. Should the dog be determined to be unacceptable to sell, the buyer shall present written evidence, from the above said Veternarian, within 6 days of the puppy being picked up, the Seller shall offer a full refund. The dog must be returned, at the Buyer/s expense, to the seller prior to any refund. All returned puppies may be euthanized at the Sellers sole discretion. The buyer forfeits any ownership rights of a returned puppy.
If the Buyer fails to have their puppy inspected, as described above, all health guarantees are void.
Furthermore, the Sellers will offer a genetic disease guarantee of one year. If the Buyer/s follows the terms stated above, and the puppy develops a genetic health issue of such a serious nature that the quality of life of the puppy will be shortened or seriously altered, the Buyer/s may return the puppy for a future puppy or a cash refund at the discretion of
the Sellers. The buyer/s is aware that this warranty does not cover in any way: viral or bacterial infections; accidents; environmental irritants; abuse or lack of nutrients. If the Buyer/s fights or participates their puppy in any extreme sports that may put unusual stress on the health of the animal, all warranties are void. This warrantee does not include usual bull dog genetic traits such as: snorting, grunting, watery eyes, running nose, bloating; dysplastic hips. Also, genetic traits are not, for the purposes intended in this guarenttee, considered genetic disease. Examples of such traits, but not limited too are: aggressive or timid personalities; hyperactive or inactive personalities. This health guarenee will not include physical characteristics or appearences of the dogs that may develop that do not affect the health of the puppy. Mental illness is subject to interpretation, therefore mental illness or behavioral displays will not be guaranteed.
Hip dysplasia policy. The Sellers policy regarding hip dysplasia is based upon the following opinion from Dr Rassmussen (orthopedic surgeon with Veterinary surgical Specialist, Chaska MN) “ pretty much all bulldogs are dysplastic, and most will go sound as they mature because the hips will luxate and will no longer be painful” The Sellers believe that some Olde English Bulldogges will show sigss of lameness in their hips and most will naturally out grow this. If the Buyer/s puppy shows signs of lameness, with in the first year, they shall immediately notify the Sellers in writing. Using the postage date of the notification, the buyer will allow four months for the dog to out grow the lameness. If the dog is still lame, the buyer may return the dog, at the buyer’s expense. The Seller shall, at their discretion, either replace the dog with a puppy of equal or greater value, or refund the full purchase price of the dog. Since the Sellers opinion is that it is possible for an Olde English Bulldoggee to show hip dysplasia in an x-ray, yet the dog may still be completely functional and free of pain, that an x-ray will not be a determining factor in replacing or refunding a puppy. The determining factor will be: if a dog shows a misstep, a visual gate abnormity, or obvious signs of pain (such as yelping) for a period over four months, and the Buyer/s reported the lameness, with in the first year, as described above, the Buyer may return the puppy to the Seller.
No terms or warranties exist other than what is stated in this contract.
